The client has the right to negotiate any provisions of the agreement with the Seller before placing an order, including the terms amending the provisions of these rules and regulations. The negotiations should be conducted in a written form and sent to the Seller's e-mail address biuro@kielkowniki.pl. In the event that the client resigns from the possibility of concluding an agreement via individual negotiations, the following rules and regulations and relevant legal provisions shall be applied.
1. Introductory information
1. The online store (available at the following address: www.kielkowniki.pl) is owned by Żukowska Wnętrze.pl Katarzyna Bargłowska, registered in Warsaw, postal code: 01-695, at Krzemieniecka 9/2 Street, NIP: 9661557425, REGON: 200220244.
2. All correspondence should be sent to the following address: Hetmańska 27/ 3 Street, 04-305 Warsaw or e-mail address: biuro@kielkowniki.pl.
3. These rules and regulations are addressed to both consumers and entrepreneurs, who use the online store.
4. All goods placed in the store are new goods.
5. Definitions:
Working day – one day from Monday to Friday, excluding public holidays.
Order form – an electronic service, an interactive form available in the online store that enables to place an order, in particular by adding products to the electronic basket and specify the terms of the sales agreement, including the method of payment and delivery.
Client/Service recipient – a natural person with full legal capacity.
Product – a movable item available in the online store, which is the subject of the sales agreement between the client and the seller.
Rules and regulations - these regulations of the online store.
Online store – an online store of the service provider available at the following address: www.kielkowniki.pl.
Seller/Service provider – Żukowska Wnętrze.pl Katarzyna Bargłowska, a company registered in Warsaw, postal code: 01-695, at Krzemieniecka 9/2 Street, NIP: 9661557425, REGON: 200220244, e-mail address: biuro@kielkowniki.pl.
Sales agreement – a product’s sales agreement concluded between a client and the seller via an online store.
Electronic service – a service provided electronically by the service provider to the service recipient via an online store.
Order – declaration of will of the Client submitted via the order form that aims directly at concluding a product’s sales agreement with the Seller.
2. Electronic services in the Online store
1. The online store offers an electronic service – Order form. The use of the Order form begins when the Client adds the first product to the electronic basket in the Online store. The order is placed after the Client completes two steps:
a) After completing the Order form
b) After clicking the "Order and pay" field on the Online store website.
Until this point, it is possible to modify the entered data in an independent way. In the Order form, the Client must provide the following data: name and surname, address, e-mail address, telephone number and data regarding the sales agreement: products, quantity of products, place and method of delivery, method of payment. The entrepreneur is obliged to provide the company name and NIP number.
2. The one-time electronic service of the Order form is provided free of charge and ends when the Service recipient places an order via this platform.
3. Terms and conditions of concluding the Sales agreement
1. The conclusion of the sales agreement between the client and the seller takes place after the client places an order with the use of the order form in the online store: www.kielkowniki.pl.
2. Confirmation of the order is made when the Client receives an e-mail with confirmation from the www.kielkowniki.pl online store. At the same time, the sales agreement is concluded between the Client and the www.kielkowniki.p online store.
3. When placing an order, the Client is asked to provide his contact details (name, phone number and e-mail), as well as the address, to which the goods ought to be sent. All provided data is used solely for the purpose of fulfilling the order.
4. In the event that the Client has provided incomplete data, insufficient to complete the transaction, the www.kielkowniki.pl online store will contact the Client in order to complete the missing data. In the event that phone or e-mail contact is impossible, the transaction will not be completed.
5. The www.kielkowniki.pl store reserves the right to carry out the additional verification of the placed order by contacting the Client.
6. The Seller reserves the right to refuse orders when:
- the order form was filled out incorrectly
- the order was placed in violation of these rules and regulations
7. The client has the right to cancel the order or change the order at any time. To cancel the order, the client should immediately contact the www.kielkowniki.pl store by sending an e-mail to the following address: biuro@kielkowniki.pl or by calling: +48609766006 or +48609855833.
8. When the fulfillment of the order is impossible or may be delayed due to lack of goods or for other reasons, the www.kielkowniki.pl store will immediately inform the Client about such a situation.
9. The content of the concluded sales agreement is made available to the Client in a following way:
- These rules and regulations are made available on the website of the www.kielkowniki.pl online store
- The Client receives an e-mail message with these rules and regulations.
10. Prices of goods in the www.kielkowniki.pl store are presented in Polish zloty and are net prices (VAT: 0%). The Seller is exempt from goods and services tax
[provision of services is exempt under Article 113 section 1 (or section 9) of the Act of 11 March 2004 on the Goods and Services Tax (Journal of Laws of 2011, No. 177, item 1054, as amended].
11. The prices applicable in sales are the prices presented in the www.kielkowniki.pl online store at the time of placing the order by the Client.
12. A receipt will be attached to each shipped product. At the client's request, a 0% VAT invoice will be issued. The invoice is issued only if the data required when placing the order is correctly completed.
4. Shipping costs and order’s delivery
1. Delivery of products to the Client requires a fee. The costs of delivery of the product are indicated to the Client on the online store's website in the "delivery costs" tab and during the order’s placement process.
2. The Seller provides the Client with the following methods of delivery or collection of the product:
- Postal delivery
- Postal delivery with cash on delivery
- Courier delivery
- Courier delivery with cash on delivery
- Personal collection of goods
3. Personal collection is possible only in the city of Warsaw, after prior phone contact with the Seller: +48 609766006.
4. When the goods are unavailable in the online store, and they are only available on order, the buyer will be informed about the delivery time and asked to accept the delivery date.
5. The buyer will also be informed about the situation that goods are temporarily unavailable. In such a situation, the delivery period may be extended or the buyer may cancel the purchase.
6. The delivery time of the product to the client is 7 working days. The beginning of the delivery time is counted in the following way:
- If the Client selects the payment via bank transfer: electronic payment or payment card, from the date of crediting the seller's bank account.
- If the Client selects the payment in cash or on delivery: from the date of conclusion of the sales agreement.
5. Payments
1. The Seller provides the Client with the following payment methods under the sales contract:
a) Payment in cash on delivery upon receipt of the shipment.
b) Payment via bank transfer to the seller's account. ING Bank – account number: 16 1050 1025 1000 00922529 9164.
c) The entity providing online payment services is BLUE MEDIA S.A.
- Settlements for transactions via electronic payments and a payment card are carried out in accordance with the Client's choice via the BLUEMEDIA.PL service. Electronic payments and payments via a payment card are handled by:
- BLUE MEDIA S.A. - with its registered office in Sopot, Powstańców Warszawy 6 Street, 81-718, registered in the District Court of Gdańsk-Północ, 8th Commercial Division of the National Court Register under the number 0000320590, NIP: 5851351185, REGON: 191781561. Share capital: 2.000.000,00 PLN (fully-paid).

2. Payment terms:
- If the Client selects the payment via bank transfer, electronic payment or payment by card, the Client is obliged to make the payment within 7 calendar days from the date of conclusion of the sales agreement.
- In case of card payment, the order processing time starts from the moment of obtaining positive transaction authorization.
- If the Client selects the payment in cash on delivery upon receipt of the shipment, the Client is obliged to make the payment upon receipt of the shipment.
3. Refund of funds - In the event of the need to return funds for a transaction made by the Client with a payment card, the seller will make a refund to the bank account assigned to the payment card. Order.
6. Right of withdrawal - Returns, exchanges, complaints
1. The Client has the right to withdraw from the agreement or exchange the goods within 14 days of receiving the goods. The basis for the return or exchange is sending the goods at the client's expense: unused in the original and undamaged packaging, together with a completed withdrawal form. (Annex No. 1 to the agreement)
2. The goods along with the receipt or invoice received upon purchase should be sent via courier shipment or postal delivery to the following address: Kiełkowniki, Hetmańska 27/3 Street, 04-305 Warsaw.
3. If the goods are not damaged and have not been used and have undamaged packaging, the refund will be made within 10 days of receipt of the shipment by the www.kielkowniki.pl online store.
4. In the event of exchange of goods, the payment made for the goods in the amount of the price will be credited towards the price of the newly ordered goods. Any difference in price will be paid by the Client or refunded by the Seller to the Client's bank account.
5. In the event of any shortages or manufacturing defects in the goods, please return the goods at the Seller's expense, along with a proof of purchase (receipt or invoice) and a completed Complaint form (Annex No. 2 to the agreement) that will explain the reason for the complaint, to the www.kielkowniki.pl’s address. Complaints are considered within 10 working days from the moment of receiving the shipment with the complained goods.
6. The right to withdraw from the agreement does not apply if the goods have been mechanically damaged for reasons, for which the www.kielkowniki.pl store is not responsible, in particular due to improper use.
7. The Client is obliged to check the contents of the shipment in the presence of the forwarder. In the event of a complaint about a shipment damaged during transport, the basis for the complaint will be the protocol prepared at the time of receipt of the goods. The damaged goods along with the protocol should be sent to the www.kielkowniki.pl’s address.
8. The damaged product will be replaced with a new product, and if the goods are out of stock, the client will receive a refund or the option to choose another product at the same price.
7. Protection of personal data
1. The administrator of personal data is Blue Media S.A. with its registered office in Sopot at Powstańców Warszawy 6 Street, and the data will be processed for the purpose specified in Article 8b section 3 item 2 of the Act on Counteracting Money Laundering and Terrorist Financing.
2. When placing an order via the online store, the Client will be asked to provide the data necessary to complete the order. This includes contact details (name, email address and phone number), as well as the address, to which the purchase should be sent. Failure to provide the required data may prevent the order from being placed.
3. The Buyer agrees that his or her personal data will be processed and used for the purposes of order’s fulfillment.
4. All data placed in the store’s database will be treated as confidential and will not be made available to other entities. This data will be processed only for the purpose of order’s fulfillment. The data will be stored and appropriately protected against access by unauthorized persons - in accordance with the Act of August 29, 1997 on the Protection of Personal Data (Journal of Laws of 1997, No. 133, item 883).
5. According to the Act of 29 August 1997 on the Protection of Personal Data (Journal of Laws of 1997, No. 133, item 883), the Client has the right to view his or her data, correct this data and request its removal from the store's database.
8. Final provisions
1. Information, trademarks and product photos (placed on the website) are the property of Żukowska Wnętrze.pl. It is prohibited to copy, distribute or use them for any advertising, promotional or other purposes without the consent of the seller.
2. Kiełkownik is the property of Żukowska Wnętrze.pl and is protected by the right of registration for an industrial design, granted on 15 October 2013 by the Patent Office of the Republic of Poland, Department of Trademark Research, Niepodległości 188/192 Avenue, 00-950 Warsaw.
3. The store reserves the right to make changes to the rules and regulations.
4. The rules and regulations and their amendments come into force upon their publication on the store's website.
5. All disputes between the parties that cannot be resolved amicably will be resolved by the court with material jurisdiction over the seller's registered office.
6. In matters that are not regulated by these rules and regulations, the provisions of the Civil Code and the Act on the protection of certain consumer rights and liability for damage caused by a dangerous product of 31 March 2000, Journal of Laws No. 22, item 271, shall be applied.
7. Placing an order constitutes the acceptance of the above rules and regulations.
